Booking Terms and Conditions

1. Bookings
To make a booking with RunFun Travel please complete and sign the booking form and forward it, along with your non-refundable payment and a copy of your passport (photo/signature page). All reservations and/or purchases you make through us are subject to the terms, conditions and notices as they exist at the time the reservation is made. Payment details are referred to further in Clause 3.

2.  Prices
Prices are quoted in Australian dollars and are subject to change at any time, including changes imposed by wholesalers, service providers and airlines. Prices may change at any time final payment is made. All prices are subject to currency fluctuations until paid in full, which may result in an increase in the final price.

 3.  Payments
Bookings may be paid by instalment and can only be confirmed by paying a non-refundable initial payment, as follows:

•    Non-refundable payment as advised by RunFun Travel
•    For bookings received within 3 months of the event date, full payment must be paid to confirm your travel and entry

Final payment for each booking falls due a minimum of 3 months prior to departure, unless otherwise advised. If the balance is not paid in time we reserve the right to cancel your trip, retain your payments (which is agreed to be a genuine pre-estimate of damages and loss suffered by RunFun Travel for the non-performance of contract by you) and race entry fees and apply any cancellation charges applied by airlines, hotels or other service providers.

4.  Default
Interest due on overdue invoices will accrue daily from the date payment becomes due, until the date of payment, at the rate of 2.5% per calendar month. If you default in payment of any invoice when due, you shall indemnify RunFun Travel from and against all its costs and disbursements including the engaging of legal representation in addition to RunFun Travel’s costs of collection on an indemnity basis.

* Payments from an overseas bank account (outside Australia) incur a $20 transaction fee. 
 Please advise us if you wish to make payment via this method. All foreign bank fees are the responsibility of the payer and the invoiced amount must be received to our account. 

    Credit Card
Payment by credit card attracts a merchant fee of 1.8% for Visa and 1.6% for Mastercard. Any fees charged to RunFun Travel, arising from a chargeback or a disputed charge will be charged to the cardholder. This fee is non-refundable. 

Certain Credit card transaction fees may be levied by individual airlines, hotels and other service providers. We will advise you of these fees should they differ from the above. Fees may also be waived, in which case we will also advise you.

6.  Booking Amendments
If, after our confirmation has been issued, you wish to make changes to the arrangements, notification must be received in in writing (by email) from the person who signed the booking form, no less than 3 months before departure. In addition to any charges levied by the airlines, hotels, wholesalers or other suppliers an administration charge of $55 will be levied by RunFun Travel to cover our costs in making any changes and for re-issuing your invoice. A fee of $110 applies to any alteration by you within 2 months of departure. Certain travel arrangements and airline tickets once issued are non-changeable and non-transferable and therefore cannot be changed and any alteration requests will incur a 100% cancellation charge. New arrangements or tickets will be charged at the fares applicable at the time of your request.

7.  Cancellation
A number of events have Booking Terms and Conditions that take precedence over those stated below. 

TCS New York City Marathon, Virgin Money London Marathon, Berlin Marathon, Comrades Marathon: 
Refunds are not available at any time nor for any reason. All payments are non-refundable and non-transferrable, either to another person or event, under any and all circumstances, including but not limited to, the cancellation of the event or your cancellation of your trip.

Paris Marathon, Great Wall Marathon, Marathon du Medoc:
Prior to Final Payment:     Non-refundable payment plus 25% of further amounts received to date
After Final Payment:     No refund
After final payment refunds are not available at any time nor for any reason. Payments are non-refundable and non-transferrable, either to another person or event, under any and all circumstances, including but not limited to, the cancellation of the event or your cancellation of your trip.

These conditions are set out in the e-Brochures and/or Booking Information provided to you. Where your booking is on the basis of independent travel and not part of a group, payment in full may be required to guarantee your accommodation and this must be paid in full, in advance and on a non-refundable basis. This will be clearly set out in the email sent to you and these conditions take precedence over those stated below. Where no specific polices have been communicated, the rates below apply.

Cancellation must be advised by the person signing the booking form and communicated to us in writing (by email) directly. As this incurs administrative costs, we will retain your initial non-refundable payment and race entry fees. If the number of persons booked changes, the costs will be recalculated on the basis of the amended party size and you will need to pay any difference in the price. Our ability to recover payments made to suppliers for travel arrangements on your behalf will be reduced the closer to the departure date your cancellation is received. A sliding scale of charges reflects the risk to RunFun Travel and will be applied to your cancellation invoice as follows:

More than 80 days    Non-refundable payment plus 25% of the amount received to date
60-80 days:    Non-refundable payment plus 50% of the amount received to date
30-59 days:    Non-refundable payment plus 75% of the amount received to date
Less than 30 days:    No refund
After final payment    No refund
Entry Fee    Non-refundable once registered

The fees above are those payable to RunFun Travel and cancellations may be subject to additional fees as levied by various contractors and suppliers. In the event the race is cancelled, for any reason, the cancellation policy outlined above applies. All expenses not recovered by us will be deemed to be non-refundable. 

Depending on the timing of your booking additional terms may be applicable with regard to refunds. We recommend you take out insurance immediately your booking is confirmed. 

8. Late Payments
An $88 late payment fee is applicable for any payment received after the due date. If any payment is not received within 5 days of the due date, you will be deemed to have cancelled your booking and the cancellation fees, as outlined in Clause 7, will apply.

9.  Force Majeure
Compensation will not be payable if RunFun Travel is forced to cancel, or in any way change your trip due to war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire or adverse weather conditions, epidemic, pandemic, quarantine,  breakdown of communications facilities, outbreaks of infectious disease or any other public health crisis, acts of God, governmental acts or omissions, changes in laws or regulations, national strikes, accident or other circumstances amounting to force majeure. In the unlikely event of the cancellation/postponement of sporting events for whatever reason, RunFun Travel cannot be held responsible in any way for any monetary loss, inconvenience, or any other circumstances outside of our control, including non-refundable events.

10.  Travel Insurance 
It is a condition of booking that you have Travel Insurance. If the reason for cancellation is covered under the terms of an insurance policy, you may be able to reclaim these charges less any excess amounts indicated in the Insurance policy. Travel Insurance is not included in the travel packages. 

RunFun Travel is an Authorised Agent for CoverMore Travel Insurance (Australian residents only) and details of insurance cover are available on our website and can be supplied upon request. If you do not purchase Travel Insurance through RunFun Travel you must tick the box (above) confirming that you have been offered Travel Insurance and have declined. This forms part of your booking confirmation. Should you subsequently claim on your travel insurance there is an $85 admin charge for the supply of any paperwork related to your claim.

11.  Changes to Itinerary
We have the right to make any necessary changes to itinerary at any time and we will endeavour to advise you of those changes as soon as possible.

12.  Responsibility
RunFun Travel acts as an agent for the companies (suppliers) offering products and services in relation to your trip. While we take all reasonable care to select such suppliers, RunFun Travel will not be liable in the event you suffer loss, injury or disappointment by reason of any acts or failings of the suppliers. In any such case, your remedy will lie with the supplier. 

If is your responsibility to read our Terms & Conditions and those of any third parties which have been conveyed to you. It is your responsibility to check the accuracy of all documents provided to you. 

13. Release and Waiver of Liability
In signing the application form and its acceptance by RunFun Travel:
You release RunFun Travel and its officers, employees, agents, affiliates and bodies directly or indirectly associated with RunFun Travel from all claims, demands and proceedings arising from any loss, damage, liability or cost incurred or suffered by you directly or indirectly during the course of your travel and resulting from your personal injury, illness or death or damage to or loss of your property unless caused by the gross negligence of RunFun Travel and its personnel.
Section 60 and 61 of the Australian Consumer Law does not apply to this agreement, to the extent permitted by law.

14. Disclaimer
RunFun Travel reserves the right to refuse a booking for any reason. Should a booking be refused a full refund of all payments will be made. 

15. Privacy
We will not provide your address or email details to any third party for use for sales or marketing. We may, however, need to provide your details to race organisers, for the purpose of entry, airlines and third-party suppliers. 

COMMISSIONS
We may receive fees, commissions, gifts or financial incentives from third parties under this contract. 

SINGLE OCCUPANCY BOOKINGS
If a booking is made on a single basis, only one person may occupy a room. Any additional accompanying people must be booked through RunFun Travel. You warrant to us that all information provided by you about your trip is true and accurate, including the number of people travelling with you, and accept that any breach of a single occupancy booking may result in your booking being cancelled by the hotel or by us, in which case no refund will be granted. 

TWIN SHARE
If you are travelling alone but would like to share a room (thus avoiding the single supplement) please indicate this on your Booking Form. We will endeavour to find a suitable roommate for you (of the same gender) but this is not guaranteed. While we will do our best to meet your request, we do not accept any liability for additional costs if the room sharing arrangements are not to your satisfaction.

LAW OF CONTRACT
This contract is governed in all aspects by the law of the State of New South Wales and any legal action arising under the contract shall be litigated only in the appropriate court having jurisdiction in that state. 

DELAYS
In the event of a delay in departure, it is the responsibility of the carrier to determine delay policy. We reserve the right to change the flight/carrier in the interest of efficiency if we become aware of a major delay in advance.

PASSPORTS
 It is your responsibility to make sure all your travel documents are in order. Airlines may refuse travel if you do not have the correct documents. The name on the passport MUST match the name on the ticket. If the names do not match you may not be able to travel and your insurance policy may be invalid. Passports must be valid for 6 months after your return.
THIS IS YOUR RESPONSIBILITY

VISAS
It is each client’s responsibility to check the entry requirements of their chosen destination with the appropriate embassy, to obtain and process the correct forms with the Embassy allowing sufficient time for the application to be processed. You should always check requirements with the relevant embassy. Failure to obtain a visa is not a valid reason for cancelling the tour. 

TICKETS and TOUR DOCUMENTS
We will send you your travel documents, tickets and final travel itinerary, plus any event registration documents. It is your responsibility to keep travel documents safe while on tour. We recommend that you take a photocopy of the photo and information page of your passport and keep this is a separate place.

COVID SAFE TRAVEL
The health and wellbeing of our guests is the utmost importance to us and something we take seriously. As is our duty of care to our travellers to ensure their safety.
